LEKE POODLES ADOPTION / HEALTH CONTRACT
This contract is between Tina Webb, LEKE POODLES hereinafter referred to
as SELLER and_______________________________, hereinafter referred to
as BUYER(s).

We guarantee hips, eyes & elbows against any genetic defects for 2 years
after date of purchase. You must have official written documentation from
the OFA (Orthopedic Foundation for Animals) of bilateral dysplasia before a
replacement puppy is given. We will not honor a written statement or exams
from your licensed vet, it must be documented by OFA and the results must
be sent to our vet. If your puppy is diagnosed by OFA to have bilateral
dysplasia, we do not require that the puppy be returned to us. Our policy
allows you to replace the puppy with your choice of any puppy that we have
currently available or a future pregnancy at no cost.
Leke poodles DOES NOT GIVE ANY GUARANTEE in regards to size,
disposition, coloring, umbilical hernias, retained testicles, remaining dew
claws nor do we guarantee the pup to be clear of worms, coccidia or giardia,
as these are quite common in puppies. The Seller states that this puppy has
received at least one shot of the following vaccinations – Distemper-
Hepatitis, Leptospirosis-Parainfluenza and Parvovirus. We worm our puppies
with srongid starting around 4-8 weeks of age. Our puppies are vet checked
once before leaving to their new homes. We will provide the Buyer with shot
and worming records at the time of pick up.
If a member of the immediate family is allergic to the purchased puppy, and
you are no longer able to care for him/her, we will not refund the purchase
price or the deposit. We will not reimburse you for any purchases related to
the puppy including, but not limited to, crate, toys, food & dishes, leash,
collars and or invisible fencing or supplies related to training. We are also not
responsible for any medical bills related to an allergic reaction to the puppy.
We will be happy to provide information or assistance with placing the puppy
in a new pet home. All Guarantees pertain to the original purchaser only.
No replacements will be given due to problems that result from buyer neglect.
Buyer understands all shipping expenses are the buyer’s sole responsibility
and will not be refunded.
If for any reason, other than allergic reaction, you are unable to care for your
puppy or adult dog-PLEASE contact us immediately. We will assist you in
locating a new home for your puppy or make space available at our home to
re-home him/her. Although we will not reimburse you for the purchase price
of the puppy-we guarantee to place him/her into a loving home environment.
Unless agreed upon by LEKE POODLES (seller). This Leke poodles puppy is
being purchased as a companion animal [pet], and not for breeding
purposes. The purchaser agrees to have this puppy spayed/neutered on or
before the age of one year.
The new owner agrees to spay/neuter their puppy no later than 8 months of
age. The owner also affirms that their purchase is for a “pet home” only and
not for breeding purposes. If the purchased puppy is used to produce a litter,
Leke poodles will be entitled to be compensated for breach of contract.
The owner then agrees to pay leke poodles an additional $1000 above the
purchase price of the original puppy and $1000 per puppy that is sold from
the whelping. The general health guarantee as well as the genetic guarantee
becomes void if the spay/neuter contract is violated.
Buyer agrees to maintain this dog in good health, provide routine
preventative health care, including but not limited to, inoculations, internal
and external parasites, and preventative medications. Buyer agrees to
provide fresh water and proper quality food in the correct amounts.
Veterinary records must be provided to Seller if requesting a replacement. If
any of the above preventative care has not been provided, health warranty
will be rendered null and void.
This Puppy/Dog is in good health and free of communicable diseases at the
time of this sale. Buyer has 72 hours from the purchase and/or delivery date
to have the Dog examined by a licensed veterinarian (Buyer must pay all
veterinarian fees). If for any reason there is a physical genetic defect in the
pup, that will cause certain premature death, we will exchange the puppy. We
will not refund the purchase price for any reason. We should be contacted
immediately with the name and number of the vet responsible for performing
the exam. The vet will also need to provide IN WRITING all of the results and
a diagnosis. If a replacement pup is not available, you will have first choice of
the next litter. Failure to have the Dog examined within the above time limit
will nullify this warranty. Seller is not liable for any accident or injury of the
animal once it leaves the sellers premises. This warranty does not cover viral
illnesses, parasites, infections, improper bites, hernias, Guardia or
Coccidosis. It also does not cover illness due to the ingestion of foreign
objects, food, chemicals, or physical injury.
Under NO CIRCUMSTANCES is the dog to be placed in a pet shop, animal
shelter, or similar establishment. Under NO CIRCUMSTANCES is this dog to
be used for breeding unless otherwise arranged with the seller.
**All court costs and attorney fees will be paid for by the purchaser at the
time of the court’s decision.
**It is understood that this agreement is to protect the integrity of the sellers’
bloodlines.
The preceding paragraphs contain conditions established by the Seller to
ensure the wellbeing of the puppy/dog. The Buyer’s agreements will continue
for the duration of the dog’s life and the Seller will have the right to enforce
the agreements.
